INSURANCE DEFENSE

The attorneys at Heller, Horowitz & Feit, P.C. have an unusually broad range of experience in insurance law and reinsurance, having counseled and represented both insurers and policy holders covering a wide variety of risks.  Our experience is not limited to litigation, as we have, both as a firm and individually at other firms, counseled large and small insurance companies, corporations and individuals regarding the structure and scope of their insurance coverage.

Comprehensive General Liability.
  Our lawyers have represented some of the largest and most respected insurance companies and industrial corporations in the world in coverage litigations spanning the country and involving hundreds of millions of dollars in claims.  Many of these litigations involved questions of insurer liability for clean-up and defense costs under CERCLA and other federal and state statutes, as well as complex issues of policy construction.  We have also represented defendants in toxic tort litigation, most recently a municipality in multi-district federal litigations involving claims for personal injury and property damage caused by the contamination of water supplies and aquifers by hydrocarbon spills.

Professional Malpractice.  We regularly represent and counsel law and accounting firms in connection with actual and threatened professional malpractice claims.  For example, we represented a prominent New York law firm in a professional malpractice suit brought in the U.S. District Court in Utah, alleging misrepresentation and non-disclosure in several proxy statements and SEC filings, and counseled an accounting firm in connection with several million dollars in malpractice claims made in connection with the bankruptcy of one of its major clients.  In a related area, we have litigated several complex insurance brokerage error and omissions cases with favorable results for our clients.
