Heller, Horowitz & Feit, P.C. is intimately involved in this burgeoning area of the law involving long-term health care providers, physicians groups and medical service providers.

Medicare and Medicaid Reimbursement.  We regularly counsel our health care provider clients on issues involving reimbursement under federal statutes and the web of rules and regulations promulgated by the New York Departments of Health and Social Services and the Federal Health Care Financing Administration.  On the litigation side, we have successfully litigated rate appeals, administrative proceedings before the Department of Health, state court mandamus proceedings and federal civil rights actions on behalf of our clients.

Patients' Rights.  On a routine basis, we are called upon by health care providers to provide counseling regarding living wills, powers of attorney and DNR orders in connection with providing medical care to patients.  In addition, on behalf of our provider clients, we are often involved in the creation and administration of conservatorships and guardianships.  We are regularly consulted regarding, and have litigated, a plethora of patient-related matters including personal property, patient funds and NAMI issues.

Anti-Fraud and Corporate Compliance.  As both federal and state governments have rapidly extended the definition of health care fraud into new areas of patient care, we have been actively involved in counseling our clients on fraud prevention and in designing corporate compliance programs, and in connection with audits conducted by the Medicaid Fraud Control Unit of the New York State Attorney General's office.
